DMCA Policy

This Digital Millennium Copyright Act (“DMCA”) policy applies to https://clubedowifi.com.br and its subdomains (including en.clubedowifi.com.br) (the “Website” or “Service”) and to any related products and services (collectively, the “Services”). It describes how GW Empreendimentos Digitais (a Brazilian Enterprise), operating as “Wi-Fi Club,” “we,” “us,” or “our,” addresses copyright infringement notices and how you (“you” or “your”) may submit a copyright infringement complaint.

We respect intellectual property rights and expect our users to do the same. It is our policy to promptly respond to clear, properly formatted notifications of alleged infringement in accordance with the U.S. Digital Millennium Copyright Act of 1998 (17 U.S.C. §512).

Privacy Notice: We may forward your DMCA notice (including the contact information you provide) to the user who posted the material and to third parties (e.g., our hosting provider or the Lumen Database) for transparency and record-keeping.


Before You File a DMCA Notice

  • Verify that you (or your client) own the rights, or are authorized to act for the rights holder.
  • Consider whether the use may be fair use, licensed, or otherwise authorized.
  • If unsure, consult an attorney before submitting a legal notice. Submitting false claims can create liability under 17 U.S.C. §512(f).

How to Submit a Proper DMCA Takedown Notice

To expedite processing, your written notice must include all items below (see 17 U.S.C. §512(c)(3)):

  1. Your signature (physical or electronic).
  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works at a single site).
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate it (e.g., full URL(s) and screenshots if possible).
  4. Your contact information (full name, organization if applicable, mailing address, telephone, and email).
  5. Good-faith statement: “I have a good-faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.”
  6. Accuracy and authority statement: “The information in this notice is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

Send your complete notice to our Designated DMCA Agent listed above. Incomplete notices may be rejected or delayed.

What We May Do: If the notice is valid, we may remove or disable access to the allegedly infringing material and notify the affected user. Where appropriate, we may terminate repeat infringers’ accounts or access under a repeat-infringer policy.


Counter-Notification (If Your Content Was Removed)

If your content was removed due to a DMCA notice and you believe the removal was a mistake or that you have authorization to use the material, you may submit a counter-notification (17 U.S.C. §512(g)(3)). Your counter-notice must include:

  1. Your signature (physical or electronic).
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled (full URL(s)).
  3. Good-faith statement: “I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.”
  4. Your contact information (full name, mailing address, telephone, and email).
  5. Jurisdiction/Service of Process statement:
    • If you are in the United States: “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located.”
    • If you are outside the United States: “I consent to the jurisdiction of any United States Federal District Court in which the service provider may be found.”
    • In all cases: “I will accept service of process from the person who provided the original DMCA notice or their agent.”

Send your counter-notice to our Designated DMCA Agent above. If we receive a valid counter-notice, we may restore the material within 10–14 business days, unless the original complainant informs us that they have filed a court action to restrain you from engaging in the infringing activity.


Repeat Infringer Policy

In appropriate circumstances, it is our policy to disable and/or terminate access for users who are determined to be repeat infringers.
